Man ordered to remove flagpole
Colonel Van T. Barfort, 90, from Richmond VA is being ordered by his homeowner association to remove the flag pole on his property.

In a priority mail letter, the Coates & Davenport law firm in Richmond is ordering Barfoot to remove the pole by 5 p.m. Friday or face ?legal action being brought to enforce the Covenants and Restrictions against you.? The letter states that Barfoot will be subject to paying all legal fees and costs in any successful legal proceeding pursued by the homeowner association?s board.
Barfoot lives in the Sussex Square community in far western Henrico; its board of directors rejected a plea from Barfoot in July to approve the pole, disallowing the fixture on aesthetic grounds.

"Second Lieutenant Barfoot's official Medal of Honor citation reads:
For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.[4]"

here is what i sent the lawyer firm perusing this man
I am writing in response to the barfoot case.
What is this country coming to when a citizen cannot, under penalty of law, fly the flag that represents the strength and union of this country? Forgive me for being blunt, but that is absurd and ridiculous that ANYONE is being threatened with fines for flying a U.S. Flag in their yard, especially a war veteran as decorated as Colonel Barfoot. How do you think this makes his feel, being a war veteran that has risked his life to PROTECT the very country that is threatening him for flying their flag.
It is ABSURD, BACKWARDS, and downright DISGRACEFUL to every American that has fought in wars to protect this country. You are disgracing all fallen soldiers, and you are dishonoring their memories and spitting on their graves is EXACTLY what you are doing.
I would understand if someone were flying a mexican flag.........

You have missed the root of the whole problem - it's the prevalence of Homeowners' Associations which have morphed from entities designed to apportion shared costs into a form of local local Government complete with unnecessary rules, insane logic, political correctness, frivolous litigation etc.
As a libertarian I have to respect the rule of contract law and I am sure this guys signed up for the HOA CCR's at some point. However as a member of a HOA I can tell these entities are completely out of control and attract to the Board the worst kind of quasi-political types who get their jollies attempting to control other people's live. And in our case being completely ineffective at getting really important stuff done. But here in CA it is become very difficult to purchase a home in any kind of planned development without going the HOA route.
It's the same "too much government problem" again.

X2 Sorry but that's why this guy ( Me ) doesn't live in a home owners association or private community.
For those of you that don't know if you want to paint your house you must submit paint samples ect. Look at Irvine ca. all the houses are tan with red tile roofs. You will not see the one weirdo that would paint his house turquoise because they will make you repaint it if you don't they will. And charge you for it when you get out of jail. Same goes for lawn maintainence.
BAYONET POINT — On Friday morning, Joseph Prudente put on a pair of shorts and his "Grandpa Gone Wild" T-shirt. He took off his wedding band and put his heart medication in a plastic Wal-Mart bag.
Then his daughter drove him to jail. Grandpa had time to do.
His crime? He had disobeyed a court order that he sod the lawn at his Beacon Woods home.
His bail? Zero.
Prudente, 66, must stay in the Pasco County jail in Land O'Lakes until the required sod work is completed, under a September court order signed by Circuit Judge W. Lowell Bray.
"He's in prison for God knows how long because we can't afford to sod the lawn," said his sobbing daughter, Jennifer Lehr.
Prudente has owned a home in the deed restricted community since 1998. The covenants require homeowners to keep their lawns covered with grass.
Earlier this year, the Beacon Woods Civic Association took Prudente to court after he failed to install new sod on his browning lawn, which had withered after his sprinklers broke. The association had already sent letters telling him to resod his front and back yards by certain dates.
In an interview at the jail Friday evening, Prudente said he thought he had made a good financial hardship case to the association: His adjustable rate mortgage went up an extra $600 a month. Wachovia repossessed his Toyota Scion. His daughter and her two young children, who had fallen on hard times, moved in with him and his wife, Pat.
"To me, keeping the house is more important than the grass," said Prudente, a retired registered nurse from New York. "I just ignored them."
He ignored them, too, after the association filed a complaint in court. He ignored a court order in May, signed by Bray, giving Prudente 30 days to sod the yard.
In June, the court also awarded the association $795 in fees, which included a $645 attorney's fees and a $150 fee for "an expert witness."
By September, there was still no sod. Bray found Prudente in contempt of court, but said in his order that Prudente could "purge himself of this contempt" by doing the required work within the next 30 days. That time expired Friday.
"It is clear to the Court that the ability to avoid incarceration is well within the Defendant's grasp," Bray wrote.
Representatives of the Beacon Woods association expressed regret Prudente had landed in jail. But they said it was his own fault.
"It's a sad situation," said board president Bob Ryan, who added that the association had followed all the correct procedures. "But in the end, I have to say he brought it upon himself."
Lawyer Thomas Gurran, who represents the association, said in a statement that the association had "just wanted Mr. Prudente to comply with the lawn restriction." He added that the contempt power of judges is essential to the system.
"Many orders and judgements … would be absolutely meaningless if they could not be enforced by a judge's contempt power," he said. "This case is an example of what happens when someone defies an order entered by a judge in our country."
Prudente's family said the case had gone too far. Pat Prudente said she and her husband knew they had chosen to live in a community with restrictions. "But they shouldn't have this much power," she said.
Back at the jail — where the population is 1,132, well above the 782 capacity — Parente said he was being treated well. He has no criminal record in Florida and said his stay in Land O'Lakes was his first time ever in a slammer.
What comes next? He doesn't know. "Should I go out and rob a bank? Then I'd be back here," he said. "But then I'd get out on bail."
